I am in a similar situation to you, and had read your posts. Thank you very much for all of this.

I too entered the UK on Sept97 and attempted to apply in person to HO on Sept08. Before being able to make the application I was turned down at the 'checkpoint' counter on the ground floor of HO as there was a gap of 17days.

student visa (college) exp 31Aug
student visa (uni) start 17Sept

I left the UK in June after finishing school, got a university offer in July (all before visa expire) and obtained new student visa at the airport on 17Sept.

Luckily, HO was kind enough not to snatch the £950 cheque off my hands, but I was still gutted.
...and I'm sure you know what I mean.

I've contacted a few solicitors about my case and have received varied responses
1. it's only 17 days; it will be fine.
2. law is law, and however tell you it is ok is only after your money.
None of these people were asking for a "no win, no fee" contract, so I personally believe the second answer.

Anyway,
I have just read your latest post and was curious where you got the information from.
According to this document, my break WOULD BE considered continuous stay????
I am confused by the way they use identical examples for "Continuous residence" and "Continuous LAWFUL residence" too.
How does this new definition valid from 9Sept08 affect you? Would this not allow you for an ILR?
